During the normal course of a smaller project customers may request refunds, if applicable. This rarely occurs but sometimes, because personal finances may dictate, the customer deems a refund in his best short term interest. When agreed upon, refunds may cause budgetary interruptions for the completion of labor that setback a project's overall timeline . Conversely when refund situations may apply, customers are normally satisfied seeing through their project to the end then paying a reduction in the overall price rather than request refunds mid-project that may interrupt their project's budgeting and timeline.
Becuase of the nature of project management and contracting, any professional services performed towards the completion of a job is considered a use of our inventory of time and cannot be refunded. Used time in professional services are costs that are incurred and considered spent. Unused time meaning planned services that are not executed to date are counted as costs that have not been incurred, and in the case of advanced payment have not been earned and can therefore be refunded. Refunds can be requested in the case of certain materials or products already purchased. The following cases are standard occurrances in which refunds may apply:
• Project is terminated after payment is received and before any work has commenced.
• Change orders are agreed upon that reduce the cost of the project scope for payment already received and unused.
• The rare case of abundant materials surplus that the contractor desires to purchase back from customer.
• Products or materials purchased for installation that are deemed defective before project completion.
• Products or materials that are replaced during the course of the project that cause a reduction in overall project cost.
Beyond the above categories refunds are usually not applicable, even upon breach or termination of contract, and payment for work rendered up to date is required. Any unusual requests for refunds are handled on a per contract basis and arbitrated through legal means by which, in good faith, all parties agree on terms of satisfactory standards of delivery and payments for such delivery.
True Quality Builders LLC (TQB) has an implied limited warranty on its completed labor and services for a standard ninety (90) day period or one (1) year for housing construction. This is limited to only defects caused by improper installation or construction labor of the contracted work.
TQB reserves the right not to recognize any defects to a project that were a) not included as part of the original contracted Project Scope, b) upon inspection it is determined that defects were caused by customer or third-party negligence and/or abuse, and c) damage caused by weather, earthquake, or other acts of God, in the which insurance must be sought if held. Within the appropriate warranty period any malfunctioning products installed, due to manufacturer’s defects, will be referred to the manufacturer’s warranty and their terms. TQB will then cover reinstallation as part of its labor and services warranty.
